These terms and conditions (the "Terms and Conditions") govern the use of www.thecocktailguy.co.nz (the "Site"). This Site is owned and operated by The Cocktail Guy. This Site is a service.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

The Cocktail Guy Limited — Margarita Kit Instagram Giveaway Competition Terms & Conditions

1) Promoter

The promoter is The Cocktail Guy Limited, Auckland, New Zealand. 

2) Eligibility

• Open to residents of New Zealand aged 18 years or over.

• Employees (and immediate families) of the Promoter and any third-party partners associated with this giveaway are not eligible to enter.

• Entry is free (internet access required).

3) Competition Period

• The competition opens today, Tuesday December 9, 2025 at 4:00PM and closes on Friday Saturday 20 December at 11:59PM (NZT).

• Entries received after the closing time will not be eligible.

4) How to Enter

To enter via Instagram, participants must complete the entry steps stated in the Promoter’s Instagram giveaway post (the “Post”) during the Competition Period (for example: like, follow, comment, tag, share, etc. — as specified in the Post).

• Entries must be made by the individual entering.

• Automated, bulk, or third-party entries are not permitted.

• The Promoter reserves the right to verify the validity of entries and entrants.

5) Prize

There will be one (1) winner who will receive an at-home margarita kit prize bundle including:

• Copper BarGeek Cocktail Kit (including the same items as previously offered), plus:

• Parched salts

• Dehydrated garnish

• Garnish picks

• Salt rim dish

No cash alternative is available. The prize is not transferable or exchangeable.

6) Winner Selection & Notification

• The winner will be selected at random from all eligible entries received during the Competition Period.

• The draw will take place within a reasonable time after the competition closes.

• The winner will be contacted via Instagram DM and/or announced on the Promoter’s Instagram (as indicated in the Post).

• If the winner does not respond within a reasonable time, or is not eligible, the Promoter reserves the right to redraw.

7) Delivery / Shipping

• Prize delivery will be arranged with the winner.

• The winner is responsible for providing correct contact and delivery details.

• If shipping is required outside the Promoter’s standard service area, the Promoter may (at its discretion) offer an alternative arrangement.

8) Marketing Consent (Important)

By entering this competition, you agree to receive marketing communications from:

• The Cocktail Guy Limited, and

• our third-party partners, including Parched Garnishes.

Marketing may be sent via email, SMS, social media, or other channels where you have provided details and/or where permitted by applicable law. You may opt out of marketing at any time using the unsubscribe instructions provided in communications.

9) Privacy

• By entering, you agree that the Promoter may collect and use your personal information for the purposes of administering this competition, contacting the winner, delivering the prize, and marketing as described above.

• Personal information may be shared with third-party partners (including Parched Garnishes) to facilitate marketing and/or prize fulfilment.

• Your information will be handled in accordance with applicable privacy laws.

10) Instagram Disclaimer

This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram. By entering, you release Instagram from any responsibility.

11) General

• The Promoter reserves the right to amend, suspend, cancel, or extend the competition if required due to circumstances beyond its reasonable control.

• The Promoter’s decision is final and no correspondence will be entered into.

• To the maximum extent permitted by law, the Promoter excludes liability for any loss or damage in connection with this competition or prize.

All content published and made available on our Site is the property of The Cocktail Guy and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.

Limitation of Liability

The Cocktail Guy and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses, including legal fees, from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless The Cocktail Guy and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of New Zealand.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Payments, Cancellations & Rescheduling (Terms & Conditions)

Deposit

A $500 deposit is required to secure your booking and confirm your event date. Your booking is not confirmed until the deposit has been received.

Final Payment

Full payment is due no later than 14 days prior to your event date.
For bookings made within 14 days of the event date, full payment is due immediately upon booking (unless agreed otherwise in writing).

Cancellation & Refunds (Sliding Scale)

If you cancel your booking, refunds of the $500 deposit are as follows (based on notice provided prior to your scheduled event date/time):

• 21 days or more notice: refund of deposit less a $100 admin fee (refund $400)

• 14–20 days’ notice: 50% of deposit refunded (refund $250)

• 7–13 days’ notice: 25% of deposit refunded (refund $125)

• 0–6 days’ notice (including same day): no refund of the deposit (deposit forfeited)

If any additional amounts beyond the deposit have been paid, any refund (if applicable) will be assessed after deducting any costs already incurred in preparing for your event (for example staffing, supplier charges, courier fees, or custom items).

Rescheduling / Postponements

You may postpone or change your event date at no cost by providing 48 hours’ notice or more. Any deposit and payments made will be transferred to the new date.

If you postpone within 48 hours of your event, any direct costs already incurred (e.g., courier/supplier fees or other third-party charges) may be charged case-by-case. We will always try to be flexible.

How Notice Must Be Given

All cancellations or rescheduling requests must be made in writing (e.g., email or Instagram message) and are effective from the time they are received by us.
