These terms and conditions (the "Terms and Conditions") govern the use of www.thecocktailguy.co.nz (the "Site"). This Site is owned and operated by The Cocktail Guy. This Site is a service.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

The Cocktail Guy Limited & Chuqui™ — Giveaway Competition Terms & Conditions (March 2026 Promotions)

1) Promoter

The promoter is The Cocktail Guy Limited and Chuqui™ (a brand of The Cocktail Guy Limited), Auckland, New Zealand (“Promoter”).

2) Eligibility

• Open to residents of New Zealand aged 18 years or over.

• Employees (and immediate families) of the Promoter and any associated partners are not eligible to enter.

• Entry is free (internet access required).

3) Competition Periods

The following competitions are run by the Promoter:

Competition 1 - Chuqui™ Tee Giveaway (Instagram)

• Opens: As per Instagram post

• Closes: Monday 23 March 2026 at 11:59PM (NZT)

Competition 2 - Win a Chuqui™ Bar Set-Up (Instagram)

• Opens: As per Instagram post

• Closes: Sunday 29 March 2026 at 11:59PM (NZT)

Competition 3 - Win the Full Chuqui™ Set-Up (Email Database)

• Opens: As per email campaign

• Closes: Tuesday 31 March 2026 at 11:59PM (NZT)

Entries received after the relevant closing time will not be eligible.

4) How to Enter

Instagram Competitions (Comp 1 & 2)

To enter, participants must complete the entry steps outlined in the relevant Instagram post (the “Post”), which may include actions such as:

• Following accounts

• Liking the post

• Commenting and/or tagging others

• Sharing the post

Email Competition (Comp 3)

To enter, participants must:

• Be subscribed to The Cocktail Guy and/or Chuqui™ email database during the competition period, and/or

• Complete any entry steps outlined in the promotional email

Additional conditions:

• Entries must be made by the individual entering.

• Automated, bulk, or third-party entries are not permitted.

• The Promoter reserves the right to verify the validity of entries and entrants.

5) Prizes

Competition 1 Prize

• One (1) winner will receive:

  • Chuqui™ T-shirt / merchandise item

Competition 2 Prize

• One (1) winner will receive a Chuqui™ Bar Set-Up, including:

  • Barware Kit (Copper), including:

    • Boston Shaker

    • Toby Tin

    • Jigger (30ml / 60ml)

    • 3 x Speed Pourers

    • Fine Strainer

    • Hawthorne Strainer

Competition 3 Prize

• One (1) winner will receive the Full Chuqui™ Set-Up, including:

  • Chuqui™ T-shirt

  • Barware Kit (Copper), including:

    • Boston Shaker

    • Toby Tin

    • Jigger (30ml / 60ml)

    • 3 x Speed Pourers

    • Fine Strainer

    • Hawthorne Strainer

  • Parched Garnish Pack

General Prize Conditions:

• No cash alternative is available.

• Prizes are not transferable or exchangeable.

• The Promoter reserves the right to substitute any prize with one of equal or greater value if necessary.

6) Winner Selection & Notification

• Winners will be selected at random from all eligible entries.

Announcement timing:

• Competition 1: Winner announced shortly after closing

• Competition 2: Winner announced 30 March 2026

• Competition 3: Winner announced shortly after closing

• Winners will be contacted via:

  • Instagram DM (for Instagram competitions), and/or

  • Email (for database competition)

• Winners may also be publicly announced via the Promoter’s social media or email channels.

• If a winner does not respond within a reasonable timeframe or is deemed ineligible, the Promoter reserves the right to redraw.

7) Delivery / Shipping

• Prize delivery will be arranged with each winner.

• Winners are responsible for providing accurate delivery details.

• If delivery falls outside the Promoter’s standard service area, an alternative arrangement may be offered at the Promoter’s discretion.

8) Marketing Consent (Important)

By entering these competitions, you agree to receive marketing communications from:

• The Cocktail Guy Limited, and

• Chuqui™, and relevant promotional partners (e.g. Parched Garnishes where applicable).

Marketing may be sent via email, SMS, social media, or other channels where permitted by law.
You may opt out at any time using the unsubscribe link provided.

9) Privacy

• Personal information will be collected and used for:

  • Administering the competitions

  • Contacting winners

  • Prize fulfilment

  • Marketing purposes (as outlined above)

• Information may be shared with relevant third parties for fulfilment and marketing.

• All data will be handled in accordance with applicable New Zealand privacy laws.

10) Instagram Disclaimer

Instagram competitions are in no way sponsored, endorsed, administered by, or associated with Instagram.
By entering, participants release Instagram from any responsibility.

11) General

• The Promoter reserves the right to amend, suspend, cancel, or extend any competition if required due to circumstances beyond its control.

• The Promoter’s decision is final and no correspondence will be entered into.

• To the maximum extent permitted by law, the Promoter excludes liability for any loss or damage arising from the competition or prize.

Intellectual Property

All content published and made available on our Site is the property of The Cocktail Guy and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.

Limitation of Liability

The Cocktail Guy and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses, including legal fees, from your use of the Site.

Indemnity

Except where prohibited by law, by using this Site you indemnify and hold harmless The Cocktail Guy and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of New Zealand.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Payments, Cancellations & Rescheduling (Terms & Conditions)

Deposit

A $500 deposit is required to secure your booking and confirm your event date. Your booking is not confirmed until the deposit has been received.

Final Payment

Full payment is due no later than 14 days prior to your event date.
For bookings made within 14 days of the event date, full payment is due immediately upon booking (unless agreed otherwise in writing).

Cancellation & Refunds (Sliding Scale)

If you cancel your booking, refunds of the $500 deposit are as follows (based on notice provided prior to your scheduled event date/time):

• 21 days or more notice: refund of deposit less a $100 admin fee (refund $400)

• 14–20 days’ notice: 50% of deposit refunded (refund $250)

• 7–13 days’ notice: 25% of deposit refunded (refund $125)

• 0–6 days’ notice (including same day): no refund of the deposit (deposit forfeited)

If any additional amounts beyond the deposit have been paid, any refund (if applicable) will be assessed after deducting any costs already incurred in preparing for your event (for example staffing, supplier charges, courier fees, or custom items).

Rescheduling / Postponements

You may postpone or change your event date at no cost by providing 48 hours’ notice or more. Any deposit and payments made will be transferred to the new date.

If you postpone within 48 hours of your event, any direct costs already incurred (e.g., courier/supplier fees or other third-party charges) may be charged case-by-case. We will always try to be flexible.

How Notice Must Be Given

All cancellations or rescheduling requests must be made in writing (e.g., email or Instagram message) and are effective from the time they are received by us.
