These terms and conditions (the "Terms and Conditions") govern the use of www.thecocktailguy.co.nz (the "Site"). This Site is owned and operated by The Cocktail Guy. This Site is a service.

Premium Pre-Batched Margarita Survey Giveaway Terms & Conditions

Promoter

The promoter of this competition is The Cocktail Guy, located in Auckland, New Zealand.

Competition Period

• Entries open on Monday, 22 September 2025 and close at 11:59 PM NZST on Sunday, 19 October 2025.

• Any entries received after this time will not be considered.

Eligibility

• Open to residents of New Zealand aged 18 years or older.

• Employees of The Cocktail Guy, associated agencies, or their immediate family members are not eligible to enter.

How to Enter

• Complete the survey linked in this competition.

• Provide a valid email address.

• Tick the required consent checkbox agreeing to the prize draw Terms & Conditions and to be kept up to date with what’s shaking from The Cocktail Guy.

• Only one entry per person will be accepted. Multiple entries from the same person will be disqualified.

Prize

• 1x Cocktail Kit including a Boston shaker, fine strainer, Houston strainer, jigger, jar of Parched garnish (as shown in promotional materials). This giveaway is not sponsored. 

• The prize is non-transferable and cannot be exchanged for cash or other products.

• The Cocktail Guy reserves the right to substitute the prize with another of equal or greater value if necessary.

Winner Selection & Notification

• The winner will be selected at random from all eligible entries.

• The winner will be contacted via the email address provided in the survey within 7 days of the competition closing date.

• If the winner does not respond within 7 days, The Cocktail Guy reserves the right to select a new winner.

Use of Personal Information

• Email addresses will only be used to contact the winner and to keep participants up to date with what’s shaking from The Cocktail Guy.

• Participants can unsubscribe at any time.

• Personal information will not be shared with third parties.

General Conditions

• The competition is in no way sponsored, endorsed, or administered by Instagram.

• By entering, participants agree to these Terms & Conditions.

• The Cocktail Guy reserves the right to amend, cancel, or suspend the competition at any time.

• The decision of The Cocktail Guy regarding any aspect of the competition is final and binding.

Liability

• The Cocktail Guy is not responsible for lost, late, or misdirected entries, or for any technical issues with submitting the survey.

• Participation in the competition is at the participant’s own risk.

These Terms and Conditions are governed by the laws of New Zealand.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Cancellation Policy

Cancellations and Postponements

• If you cancel your booking giving us 21 days’ notice or more, you'll receive a full refund of your deposit minus a $100 admin fee.

• If you cancel your booking within 7 days of your event, the full deposit is forfeit.

• If you need to postpone your event, delivery can be postponed/date changed at no cost by giving us 48 hours or more notice. If postponed within 48 hours, any incurred charges will be considered on a case-by-case basis. We will always try to be flexible.
